Product Liability
When you purchase a product, you do so believing that you can use it in the manner in which it was intended to be used and be safe from injury or death. Unfortunately, thousands of people every year find out that this is an incorrect belief. Many of the high-profile product liability cases involve motor vehicles – tire defects, tread separations, and SUVs that rollover easily all provide good news stories. But many everyday products injure people in less dramatic, although equally life-changing ways. From the carpet freshener that causes serious asthma attacks to the improperly engineered lamp that causes a fire, even seemingly small defects can have long-ranging results.
At Halberg & Fogg PLLC, with office in West Palm Beach, we represent people who have been injured by exposure to dangerous substances and devices, such as asbestos, other hazardous chemicals, cosmetics, hazardous waste, medical devices, pesticides, drugs, and improperly shielded radiation. Our experience has shown that there are two different ways for a product to be defective: either it is engineered defectively or a particular product, or run of a product, is manufactured with a defect. In either case, if the result is injury to an individual, the responsible company must be held liable for damages.
Recoverable damages can include lost wages, uncovered medical expenses, and pain and suffering. In addition, in these cases under very special circumstances, we can sometimes recover punitive damages, designed to punish a company who has willfully and knowingly allowed a defective product to be on the open market, fully realizing the extent of the injuries the product will cause.
In product liability cases, as in all our personal injury cases, we do not charge you a fee unless and until we recover money damages for you. So contact us if you have been injured by an unsafe product to set up a free initial consultation. We will show you what we can do for you.
