Birth Injuries
One of the happiest moments in your life should be when your child is born. You have nine months of anticipation, planning out in your mind all the things you want to do with your child and the landmarks he or she will achieve in life. Unfortunately, not all births go as planned – there may be complications during pregnancy or a premature birth. And even though many birth emergencies can be handled so that there is a minimal effect on baby and mother, mistakes are sometimes made and procedures are not followed which can result in significant injury. Brain damage, cerebral palsy, orthopedic injury – this disheartening list can go on. Some birth injuries truly could not be avoided, but proper monitoring and the use of standard procedures could prevent many.
At Halberg & Fogg PLLC, we have investigated a lot of birth injury cases in Florida, and have brought suit in many of them. As with any medical malpractice case, the mere fact of an undesirable result is not enough to bring a lawsuit. However, we have the experience and the medical knowledge to determine what birth injuries could have been avoided by appropriate care. When we determine that a case is due to some type of medical malpractice, we will get the case ready for trial – finding the right experts to testify and otherwise preparing to take the case to a jury. We will also work at negotiating settlement during this time. We will evaluate and present any settlement offers that are received for you to decide whether to take. We will always work in your child’s best interests, however, and no settlement offer will ever be accepted without your permission.
Our goal is to get the money for your child that he or she will need to live a comfortable and productive life. And although the money will not make up for all the lost opportunities, at least you will know that your child will receive the care he or she needs.
If your child has been injured during the birth process, contact us at our office in Miami or our office in West Palm Beach to set up a free initial consultation. If you have a case, we will not charge a fee until you recover money damages. Let our compassion and experience work for your child.
